Trial Victory for Jonathan Beltram and Colleen Deziel
Following a two-week jury trial in Orange County Superior Court, AMC attorneys Jonathan Beltram and Colleen Deziel obtained a complete defense verdict! The lawsuit involved a two-vehicle rear end collision and plaintiff was seeking damages more than $1.1 million. Plaintiff was rear ended, and her vehicle spun 180 degrees before coming to rest in a nearby green belt. Plaintiff argued because of the collision, she required surgeries to her lumbar spine, cervical spine, and left shoulder along with lifetime medical care to include physical therapy, chiropractic care, imaging, physician visits, and epidural injections. In defense, AMC argued it was the erratic behavior of an unknown male pedestrian who ran across four lanes of traffic and into plaintiff’s lane of travel that led to this collision and that any structural changes to plaintiff’s spine were the result of the natural aging process and/or other factors, and not the subject accident. After deliberating for an hour and a half the jury returned a full defense verdict, reasoning that plaintiff had not sufficiently established that AMC’s client’s negligence was a substantial factor in causing her injuries.
